The Fisher vs. Hasenjager custody dispute originated in Mercer County, Ohio, in the juvenile court of Judge Mary Pat Zitter.
What this case means for Ohio.
The Ohio Supreme Court appeal challenges the legitimacy and constitutionality of having two conflicting laws regarding how a judge may modify a shared parenting order.
The current duel statute situation violates the US Constitution, 14th Amendent, Section 1 and The Ohio Constitution, Article I, Section 1.
Essentially, eliminating a citizens right to "Due Process."

3rd District Court of Appeals
Lima, OH |
 |
| Appellate Districts with precedents that are in conflict with the decision reached by the 3rd district regarding the Fisher case. |
 |
| Appellate Districts with decisions supporting the judgement. (only the Fisher case) | The simple concept is: If a judge has two opposing laws to choose from when modifying a shared parenting order, then a judge may legally decide either way they want regardless of the situation. This provides the judge with absolute power when modifying a shared parenting plan in the state of Ohio. Family court law becomes a issue of favoritism, instead of justice. Thus, a shared parent is not being governed by law, but by the arbitrary whim of a judge.
Currently, many people think a shared parenting order will safeguard their relationship with their children. In reality it reduces the legal protections against future modifications. Unfortunately, Ohio treats shared parenting as an empty shell into which a judge can pour whatever custody concoction they desire.
This conflict has been raised 5 times in different District Court of Appeals all over Ohio in the last 20 years or so. In all previous situations the issue was resolved at the District level. When this case reached the 3rd District Appellate court in Lima, Ohio, the decision conflicted with existing precedence. Thus began our journey to the Ohio Supreme Court. We are left to ponder how many children and parents have suffered from this situation. Many do not have the fortitude or finances to pursue justice.
Honestly, I really didn't either. What I did have was an unbending love for my daughter and a burning righteous anger against injustice. God has walked before me and caused all this to happen, I have simply performed my duty as a father.
The last defense we have against judicial tyranny, is free citizens willing to fight back.
Please join me in this fight for our children's sake!
Sincerely,
Paul Fisher
